MCS Directory Terms and Conditions
ACKNOWLEDGMENT AND ACCEPTANCE OF SERVICE AGREEMENT
By completing the service registration form and clicking the "I accept" button, you represent and warrant that you are 18 years of age or older, that you agree to provide true, accurate, current and complete information (including an accurate MCS Certification certificate number and date), as prompted by the registration form, and that you agree to be bound by this agreement.
MCS Directory Ltd reserves the right, in its sole discretion, in the future, to change, modify, add or remove all or part of the Agreement at any time.
DESCRIPTION OF The MCS Installer DIRECTORY (www.mcsdirectory.co.uk)
The MCS Installer Directory (www.mcsdirectory.co.uk) is a fee-based service provided by MCS Directory Ltd for inclusion on the MCS Installer Directory (www.mcsdirectory.co.uk) of companies with MCS Certification. Inclusion in the Directory is only on acceptance of these Terms and Conditions and on payment of the appropriate fee. Only MCS Certified companies will be accepted.
In order for MCS Directory Ltd to consider your details for inclusion in the MCS Installer Directory (www.mcsdirectory.co.uk), you must submit a valid credit card number as part of the registration form, unless you are opting for a listing type that does not require payment. You agree that your credit card will be charged the current, applicable fee for the MCS Installer Directory (www.mcsdirectory.co.uk). If your details are included, you agree that after one month (or one year if that option was selected), your credit card will be charged the Recurring Fee for continued inclusion in the MCS Installer Directory (www.mcsdirectory.co.uk) depending on the listing type chosen. MCS Directory Ltd, however, reserves the right to remove your details if it fails to meet the minimum criteria .
The current fees for The MCS Installer Directory (www.mcsdirectory.co.uk) are detailed on or website. It is the applicants responsibility to keep credit card information current.
Nothing in this agreement obligates MCS Directory Ltd to list your details on The MCS Installer Directory (www.mcsdirectory.co.uk) but no payment will be charged if we decide not to list your details on The MCS Installer Directory (www.mcsdirectory.co.uk).
MINIMUM SITE CRITERIA
All details submitted to The MCS Installer Directory (www.mcsdirectory.co.uk) must meet the following minimum criteria:
* The MCS Installer Directory (www.mcsdirectory.co.uk) is a search facility for MCS Certified companies. We accept submission from MCS Certified companies only;
* The company must have a valid MCS Certification number and date of certificate;
* The company must list a valid address and contact details;
* The website links must be the companies own website and not a link to a third-party website. Any website link must not have any pornographic content/ objectionable or offensive content or should not malign any religious group or sentiments;
* If the website is a commercial web site, the official business name must be visible to any visitor to that site;
* The site must clearly define its purpose, products, and/or services;
* The site must not already appear in our Directory;
* The site must not contain any parts under construction;
* The site must be in the English language (or have an English version available);
These criteria are minimum requirements only, and MCS Directory Ltd, in its sole discretion, may consider other criteria before accepting or rejecting a listing.
SELECTION AND LISTING
MCS Directory Ltd reserves the right to decide whether, where, and how a company is listed on the MCS Installer Directory (www.mcsdirectory.co.uk) but this will be based on address and postcode as dictated by Google™ latitude and longitude calculations. If MCS Directory Ltd accepts your company for inclusion in the Directory, MCS Directory Ltd will consider your preferences, but reserves the right to list your details in any category MCS Directory Ltd deems appropriate, in its sole discretion. Companies can only be listed under one address for one fee. To have separate branches listed, then a fee for each branch must be paid.
MCS Directory ltd also reserves the right, in its sole discretion, to remove your details from the MCS Installer Directory (www.mcsdirectory.co.uk) at any time, for any reason, including but not limited to, a change in the nature of your business, or services. No further payment will be charged if your details are removed from the MCS Installer Directory (www.mcsdirectory.co.uk).
PARTICIPATION
If you wish to discontinue your listing on the MCS Installer Directory (www.mcsdirectory.co.uk), you must send a notice to MCS Directory Ltd. Please state that you wish to withdraw your details from MCS Directory. To avoid your credit card being billed for the Recurring Fee, requests for withdrawal must be received by MCS Directory Ltd at least five (5) business days before the end of the period that you intend to be your last date of inclusion. The "end of the year" is defined as 365 days from the date that your details were added to the MCS Installer Directory (www.mcsdirectory.co.uk). The "end of the month" is defined as one calendar month from the date your details were added to the MCS Installer Directory (www.mcsdirectory.co.uk). Once MCS Directory Ltd receives such notification from you, your participation in the MCS Installer Directory program will cease and your listing will be removed at the end of the period. If you request that your listing be removed before the end of a period for which you have pre-paid the Recurring Fee, you agree that MCS Directory Ltd will not be required to refund any portion of such fee.
APPLICANT PRIVACY
MCS Directory Ltd maintains information about Applicants on MCS Directory Ltd servers, including but not limited to Applicant's registration information. Applicant agrees that MCS Directory Ltd may use such information in aggregate form for marketing or other promotional purposes. Applicant agrees that MCS Directory Ltd may disclose such information in the good faith belief that such action is reasonably necessary: (a) to comply with the law or legal process; (b) to enforce this Agreement; or (c) to protect the rights or interests of MCS Directory Ltd or others; provided, however, that nothing in this section shall impose a duty on MCS Directory Ltd to make any such disclosures.
MCS Directory Ltd may contact Applicant regarding MCS Directory Ltd services using the Applicant's email address provided during the registration process (or as updated by Applicant).
DISCLAIMER OF WARRANTIES AND LIABILITIES
The service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability or fitness for a particular purpose. Neither this agreement not any document furnished under it is intended to express or imply any warranty that the service will be uninterrupted, timely or error-free. Some jurisdictions do not allow the exclusion or limitation of implied warranties, so some of these exclusions may not apply to you.
MCS Directory Ltd, and its parents, subsidiaries, affiliates, officers, directors, shareholders, employees and agents shall not be liable, under any circumstances or legal or equitable theories or data, interruption of business or for any indirect, special, incidental or consequential damages of any character even if MCS Directory Ltd is aware of the risk of such damages, that result in any way from applicant's use of or inability to use this service, MCS Directory Ltd acceptance or rejection of a company, or MCS Directory Ltd continued listing of a company on the MCS Installer Directory (www.mcsdirectory.co.uk).
MCS Directory Ltd liability to applicant shall not, for any reason, exceed the amount actually paid by the applicant to MCS Directory Ltd under this agreement.
